1. Introduction

This website and any other websites and online schools to which the Terms and Conditions are linked (each, a “Website”) are owned and maintained by Ogdoad Ltd (“we,” “our,” “us”) and governed by these Terms and Conditions.

We offer the Website, including all information, tools, and services available from the Website to you, the user, conditioned upon your acceptance of all terms and conditions stated in our Terms and Conditions. By accessing, using, subscribing, or placing an order over the Website, you and your business (including any sub users you may have) agree to the terms and conditions set forth herein.

2. National and International Orders

Orders on Our Website
National and international orders may be placed on our secure website.

• For international orders, payments can be made either by credit card (Visa or Mastercard only) or PayPal.
• Orders within New Zealand may be placed with payment being made by credit card (Visa or Mastercard only), PayPal or direct bank credit.

3. Shipping Policy

Local Orders
All orders placed for delivery within New Zealand incur a flat rate fee of NZ$8.00 postage and handling and the goods are sent via tracked courier to a street address or by New Zealand Post to a PO Box or rural address. We aim to process your order as quickly as possible. Estimated delivery time: 2-5 working days (rural deliveries may take longer). For courier deliveries, you will receive an email order confirmation and order number and will be able to track the delivery status of your order online.

International Orders
We have loyal customers who are based all over the world. Available shipping options will depend on the value and weight of your order:

• International Economy – trackable. ONLY AVAILABLE ON ORDERS VALUED UP TO NZ$250 OR LESS, AND UNDER 2KG
• International Courier – trackable, signature required. ONLY AVAILABLE ON ORDERS VALUED UP TO NZ$1000 OR LESS
• International Express Courier – trackable, signature required. AVAILABLE ON ALL ORDERS

The exact cost of your order will be displayed during the checkout process, however you can get a quote for the delivery cost of your parcel at any stage of your ordering process on the Shopping Cart summary page. We aim to process your order as quickly as possible. Estimated delivery time: 7 – 14 working days (depending on method).

As per New Zealand regulations, the retail price of your products must be shown on the consignment note of your parcel. Customs and import regulations vary between countries and are subject to change without notice. Some of the products that we sell may be restricted or prohibited within your country. It is your responsibility to ensure that any goods which you order are not restricted or prohibited in your country. Please note that any customs clearance, taxes, duty or inspection fees incurred upon arrival are beyond our control and are your responsibility.

If an order is returned to us by your country’s customs authority in a resalable condition, we will refund you the value of the products received. We don’t provide refunds on parcels that are detained or confiscated by your country’s customs.

We recommend that you contact your local Customs Office for further information.

We cannot accept liability for goods that are lost in transit outside of New Zealand.

4. Returned Merchandise and Refund Policy

We pride ourselves in offering you a quality service on all levels. Our products are treasures and are packed with extra care. However, in the event of damaged or faulty products, or incorrect products being packed, we are happy to replace the goods at no extra charge. Please choose your items carefully as we do not refund or replace products for incorrect orders being processed.

5. Cancellation Policy

Orders will be processed once payment has been made. Once payment confirmation has been received the order cannot be changed or cancelled. Please choose carefully.

6. Prices and Currency Disclaimer

Prices are subject to change without notice. All prices are correct at time of publication; however we reserve the right to alter prices for any reason.

We have used our best efforts to obtain the most accurate and timely currency rates. Accordingly, we do not guarantee the accuracy, timeliness, reliability or completeness of the rates. Using this service, you are deemed to have agreed that any reliance on or use of the rate of conversion shall be entirely at your own risk. In no event shall Ogdoad Ltd or any of its data providers be liable for any direct, indirect, consequential or exemplary damages arising from the use of this service.

The system and structure with its associated descriptions using flower essence names is the sole property of Franchelle Ofsoské-Wyber. The keywords, archetypes and descriptors used to define the First Light Flower Essences of New Zealand^® system and structure of 185 essences made from native New Zealand plants and flowers are the intellectual property of Franchelle Ofsoské-Wyber.

You can use this system and structure with its associated 10ml stock essences to create 20-25ml First Light Flower Essences of New Zealand^® flower essence blends for personal use by yourself, your friends and family or your clients after a consultation with you. When making a 20-25ml First Light Flower Essences of New Zealand^® flower essence blend a First Light Flower Essences of New Zealand^® blank label is to be used on the bottle or the label on the flower essence bottle should include the following statement: “Flower essences supplied by First Light Flower Essences of New Zealand^® – all rights reserved”.

All of our products are our intellectual property and as a matter of policy we do pursue any unauthorised use.

First Light Flower Essences of New Zealand^® and First Light Porta Alchémica^® products are created by Franchelle Ofsoské-Wyber and are part of in-class and online study educational programs owned by Franchelle Ofsoské-Wyber. These products are used as part of copyrighted in-class and online study educational programs that have been created and made publicly available by us. Under no circumstances whatsoever may they be used as part of any other educational or study program made available to the general public unless permission to do so has been received in writing from Franchelle Ofsoské-Wyber.

8.3 Using Our Published Material

All material in written, video or audio form is protected under copyright law.

You must follow the terms outlined below when using or reproducing any material published in written, video or audio form, including but not limited to websites, courses, books, ebooks, brochures, newsletters, social media posts by us and its associated brands, websites and online schools for your own use:

1. When quoting, using or reproducing any material for review and endorsement purposes that is over 25 words long, permission must be obtained in writing from Franchelle Ofsoské-Wyber via email. You will be required to submit a sample of what the material is to be used for via email to Franchelle Ofsoské-Wyber prior to the material circulating. If you require specific images or text from us please email your request with full details of what you require and your intended purpose and uses thereof.
2. When quoting, using or reproducing any material the source of the information must be accurately cited, e.g. Reference: The Sacred Plant Medicine of Aotearoa Volume 1 by Franchelle Ofsoské-Wyber or information reproduced with permission from The Sacred Plant Medicine of Aotearoa Volume 1 by Franchelle Ofsoské-Wyber.

Under no circumstances may any logo owned by Franchelle Ofsoské-Wyber be used without obtaining permission in writing from Franchelle Ofsoské-Wyber.

Should permission to use our logo be given, it does not imply company representation, but rather professional association with the company. The logo must be used in a manner and context that accurately represents the brand, its products and services. The brands are trademarks and are copyright with all rights reserved to the owner.

Franchelle Ofsoské-Wyber holds exclusive rights to the trademarks registered under its name. Any time the trademarked name is used it must be accompanied by a ® to denote that it is a registered trademark.
